What

Legal Management is the Process of managing all of the legal aspects and deliverables (eg, signed Contracts) of a project.

Legal Management consists of the following major Procedures:

  1. Identify Contracts required.

  2. Obtain copies of standard Contracts.

  3. Review applicability of Contracts to specific deal.

  4. Review Contracts for acceptability.

  5. Draft new Contracts clauses.

  6. Negotiate commercial arrangements.

  7. Negotiate Price.

  8. Negotiate and Sign Contracts.

  9. Sign Contracts.

  10. Place orders.

  11. Review All Contracts.

  12. Renew All Contracts.

  13. Terminate All Contracts.

  14. Protect copyright.

  15. Review and negotiate vendor Contracts.

  16. Perform statutory legal obligations.

Why

When and Where

This technique is used throughout the whole project lifecycle and is not limited to any specific project lifecycle phase.

How

Legal Management addresses the full spectrum of contract development, review, negotiation and execution relating to a project. This applies equally to contracts with vendors (eg, hardware, software and services vendors) as to contracts with Customers.

It also addresses all legal issues associated with the Application System being built (eg, license agreements, ability to distribute components sourced from other parties (eg, Development, Maintenance and Support Tool vendors), intellectual property, etc).

It also addresses all legal issues associated with hiring and terminating Project Team members (permanent staff and contractors) as well as all vendors.

It also addresses all legal constraints on the project.
