Terms of Use, Policies and User Conduct

1. General Terms of Use

1. Privacy We take your (and our) privacy seriously.
• We never sell your e-mail address to spammers.  Your e-mail address is used to provide you with feedback from the PMComplete™ system and inform you about issues relating to PMComplete™ such as system updates and changes.
• We will only look at the data that you have stored in the PMComplete™ data base if you ask us to do so (either explicitly or implicitly because you have asked us to investigate something for you).
2. Continuous Upgrades We are continually upgrading this site.  We put in new software revisions frequently (approximately once per month).  While we try to avoid problems, new software sometimes has bugs.  Please use the Contact Us function (on the left) to send us descriptions of any problems that you may encounter.
3. Intended Use The PMComplete™ service is intended for use as described in this web-site only.  Any other type of use is forbidden.
4. Liability is limited to a refund of no more than the monies paid.  There is no liability for any of the content supplied.  It is the responsibility of the System User to ascertain fitness for use.
5. Disclaimer Client data that appears as part of any displayed pages is their own responsibility.  We will not be held liable for anything.  Pages describing our own products, services and company are believed to be correct, but not guaranteed in any way.
6. Illegal Use The PMComplete™ web site is hosted on a server that is located in Sydney, Australia.  You may not use this server for any purpose which is considered illegal in Australia or in the state of New South Wales.
7. Advertising We obtain revenues from advertising (sorry!), so there are a few rules concerning advertising:
• We reserve the right to display advertising on any or all of the pages which originate from our web server.
• Users of our service may not display their own advertising on any page that originates from our web server.
• Users of our service may not remove the advertising from any web page which originates from our web server, nor use any such web page without displaying the associated advertising (for example, if you have a program that uses the results that we generate, that program must also display the advertisement).
8. Terms of Use Changes These Terms of Use will change from time to time.  Updates to these Terms of Use will be posted here.  Significant changes will be e-mailed to all System Users.
9. Copyright The entire site content is Copyright 1998 - 2012 by PMComplete Pty Ltd (ACN 005 726 429).  Other trademarks are the property of their respective owners.
10. Provisioning will be performed immediately we are notified.
11. Activation will be performed immediately your payment has been cleared.
12. Deactivation occurs at the end of the month that you have nominated.
13. Multiple System Users must not use the same User Name and Password for signing in to use the system.
14. Backups are performed of all PMComplete™ data base data each night (somewhere between 03:00 am and 03:30 am Eastern Australian Time).  In the unlikley event of a system failure, data will be restored to the previous night's backup.  It is the System User's responsibility to keep a manual copy of all transactions applied to the data base between backups and to re-apply those transactions should it be necessary to restore the data base to its state prior to the system failure.

2. Trial and Demonstration Areas Terms of Use

1. Usage of the PM^Complete™ Trial and Demonstration areas is completely FREE
2. We ask you to register to use the Trial area so that the system knows who you are and can assign ownership rights to certain data that you create
3. We do NOT ask for credit card information, because this is not a "bait" to get you "hooked"
4. There are very few restrictions as to what you can do in the Trial area.  You:
• Can't perform Static Type Transaction maintenance functions
• Can't perform System Administration functions
• Can't change your Password
• Can't change your Workgroup
5. As well as these restrictions for the Trial area, Demonstration area System Users are also inhibited from maintaining any data and may not perform any functions
6. You can continue to use the Trial area free for 90 days from the date of registration
7. Any data that you enter in the Trial area can be converted (by you) to the Production area should you wish to use the Production area
8. Your Trial area data will be deleted 30 days after the free period
9. No Security is provided on any data in the Trial area.  Other (unrelated) Trial area System Users will be able to view, report on, add to, modify and delete your data
10. PMComplete Pty Ltd reserves the right to delete any inappropriate data found in either the Demonstration or Trial areas

3. Production Area Terms of Use

1. 30 days notice is required to deactivate a non-replaced System User
2. Replacing one System User with another can occur immediately upon notification to PMComplete Pty Ltd
3. Billing is performed on a monthly basis and is always for a full month in advance.  Billing occurs during the first few days of the preceeding month.  Billing is based on the number of named System Users
4. Payment is expected to be immediate because all billing is performed through a credit card.  Should payment not be received (eg, because the credit card is cancelled or expires) then we reserve the right to terminate the service immediately until alternative payment arrangements have been made and the payment is received
